The petitioner has preferred this application for grant of regular bail in a case registered under sections 8(c), 20(b)(ii) (B), 22 and 27(a) of the N.D.P.S. Act.

As per the prosecution case, a total of 93.1 kgs of ganja was recovered from the possession of Moti Ram while other quantities were recovered from other accused persons. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. His name transpired in the confessional statement of co-accused Moti Ram, which has been enclosed with the petition, made before police wherein he states that the petitioner had taken a total quantity of 20 kgs

Patna High Court CR. MISC. No.20467 of 2021(2) dt.21-09-2021 2/2 of ganja from him. It is submitted that except for the statement of the co-accused made before police, there is no material against this petitioner. No incriminating article has been recovered from the petitioner's possession. He is in custody since 4.10.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the Court directs the petitioner to be enlarged on bail in connection with Bhabua (Sonhan) P.S. Case no.654 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, Kaimur at Bhabua.
