2. The petitioner has preferred this application for grant of regular bail in connection with Dawath P.S. Case No. 187/2018 dated 21.12.2018 registered for the offence punishable u/s 409, 420, 467 and 468 of the Indian Penal Code.

3. As per the prosecution case, the informant along with DCLR committed joint inquiry of godown of the petitioner and deficit of 1894.09 quintals of rice and 474.69 quintals of wheat was found and in this manner, Rs. 73,26,116.96/- was embezzled.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.7757 of 2025(2) dt.17-03-2025 2/3 this case. As per the FIR, the petitioner is said to be an Assistant Godown Manager of the Bihar State Food & Civil Supplies Corporation, Rohtas at Sasaram. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner vide order dated 18.12.2019 in Cr. Misc No. 49307 of 2019 has stated that he is ready to deposit an amount of Rs. 15,00,000/- in two installments in the court below which shall be subject to final outcome of the case. Thereafter, he was directed by the Co-ordinate Bench of this court to "deposit an amount of Rs. 7,50,000/- in the court below, which shall be subject to final outcome of the case. It was further made clear that after release on provisional anticipatory bail, the petitioner shall deposit the rest amount of Rs. 7,50,000/- in the court below within next six weeks and if the petitioner deposits the total amount of Rs. 15,00000/- in the aforesaid manner, the court below shall confirm the provisional anticipatory bail granted to the petitioner and if the petitioner fails to do so, the provisional anticipatory bail granted to the petitioner shall stand cancelled by the court below itself." However, the petitioner failed to comply with the above order.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.7757 of 2025(2) dt.17-03-2025 3/3 of the case as well as the gravity of offence, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Dawath P.S. Case No. 187/2018 pending in the court of learned S.D.J.M, Bikramganj (Rohtas).

7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
