====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-02-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is seeking anticipatory bail in connection with Silao P.S. Case No. 121/2018 registered under Sections 406, 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner had borrowed only Rs. 1 Lakh from the informant but he had issued a cheque towards refund of the same which has been manipulated and now the petitioner is being made liable to pay Rs. 4 Lakhs. Learned counsel submits that the petitioner is ready and willing to pay a sum of Rs. 2 Lakhs to the informant for the present subject to result of the case. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.
In the given facts and circumstances of the case, this
Patna High Court Cr.Misc. No.8246 of 2019(2) dt.18-02-2019 2/2 court directs that in the event of his arrest/surrender before the court below within a period of six weeks from today, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Silao P.S. Case No. 121/2018, subject to condition that while submitting the bail bond petitioner shall pay a sum of Rs. 2 Lakhs to the informant by way of a demand draft or banker's cheque drawn in favour of the informant which the informant will receive without prejudice to his right and contentions and the same will be subject to result of the case. This will be in addition to the conditions prescribed under Section 438(2) of the Code of Criminal Procedure.
