The petitioner apprehends his arrest in Dagarwa P.S. Case No.235 of 2020 registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 37(c) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the alleged recovery has been made from the common house which belongs to the mother of the petitioner as has been stated in the supplementary affidavit. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a

No.19779 of 2021(6) dt.03-02-2022 2/2 period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of Special Excise Judge, Purnea in connection with Dagarwa P.S. Case No.235 of 2020, subject to the conditions as laid down under Section 438

(2) of the Code of Criminal Procedure.
