JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 This application to the extent it relates to petitioner no. 1, namely, Daulat Devi, stands dismissed as withdrawn vide earlier order dated 18.12.2014, since she has been arrested during the pendency of this application. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner no. 2, namely, Usha Devi, seeks anticipatory bail in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.
Keeping in view the submission that the petitioner is a lady and there is no specific allegation of assault against her in the First Information Report and also the fact
Patna High Court Cr.Misc. No.47083 of 2014 (3) dt.07-05-2015 2/2 that another similarly situated co-accused, namely, Jagmohan Sah, has been granted bail vide order dated 23.07.2014 passed in Cr. Misc. No. 24833 of 2014 by another Bench of this Court.
In view of the facts as noted above, let the petitioner no. 2, namely, Usha Devi, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 142 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
