JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Informant, an M.L.A. received call from mobile SIM No.7352747984, who asked for payment of levy. It has further been stated that such nature of demand was also made at an earlier occasion.
From perusal of the record, it is evident that case was registered against user of SIM No. 7352747984. From the order impugned, it is evident that there happens to be complete absence of concrete evidence against the petitioner connecting his complicity with SIM No. 7352747984.
That being so, petitioner, Bharat Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.48623 of 2015 (02) dt.02-11-2015 satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P. S. Case no.194 of 2014, subject to condition that petitioner will have his physical presence before the Minapur Police Station one's in a month. To comply the same, the learned lower Court is directed to communicate to Officer-inCharge of the P. S. concerned. The O/c will issue a certificate, which will be submitted by the petitioner before the learned lower Court. Failure on the part of the petitioner will deprive him from enjoying the privilege. The aforesaid condition will be operative till pendency of instant trial.
