Heard learned counsel for the petitioner and learned counsel for the respondents.

Petitioner has prayed for the following relief/s: "For issuance of writ certiorarie to writ/writs, order/ orders to the respondents, who are not take any action to remove the encroachment in village parsa within the Khaira Block, District- Jamui. i. Forther for the issue the mandamus to the

Patna High Court CWJC No.9664 of 2018(2) dt.06-01-2020 2/3 respondents, they take action against the encroacher who are encroach the public road or land of Khata No. 36, 61, 64, 82, 84,89,128, 94, 132 situated at village /parsa, within Khaira block, District Jamui.

ii. Further directed to respondents to stop the any construction or encroachment in the public land or Road which is connected to the village parsa from Main Road Khaira.

iii. Further directed to respondents to how the encroacher encroach the public road or land while petitioner intimate him by the written letter or verbally.

iv. Further pray to issue appropriate writ/writs, order/orders, direction/directions to the respondents as your lordship may deem fit and proper in the interest of justice."

After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof.

We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
