The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code in connection with Chapra Muffasil P.S. Case No. 134 of 2016.
The impugned order reveals that the petitioner is already on police bail. Hence the learned Sessions Judge recorded that prayer for anticipatory bail is not maintainable, however directed the petitioner to surrender within a month and the court below would consider the prayer in the light of judgment of this Court. The petitioner did not surrender within the aforesaid period rather preferred this anticipatory bail application.
Hence, this application stands dismissed. Petitioner shall follow the direction of the Sessions Judge. (Birendra Kumar, J) mantreshwar/- U T
