The petitioner seeks bail in Mithanpura P.S. Case No. 113/2017, instituted for offences under Section(s) 52 of the Prisoners Act read with Sections 20 and 22 of N.D.P.S. Act. It is alleged in the written report that this petitioner was brought for production before the learned Judicial Magistrate 1st Class, Muzaffarpur in connection with Sahebganj P.S. Case No. 271/2016 for the offence of Arms Act. While he was again taken back inside the jail after production, search was made. About 25gm of Ganja and some Matmaila substance kept in a polythene was recovered from possession of this petitioner. Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.8429 of 2019(2) dt.13-02-2019 2/2 seizure-list is part of F.I.R. wherein it is mentioned that about 25 gm of Ganja kept in black polythene and some Matmaila article has been recovered. Till date there is no any information about the article which was said to be Matmaila article. Petitioner is in custody since 28.07.2017.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, Muzaffarpur in connection with Mithanpura P.S. Case No. 113/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
