Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Sessions Trial No. 1063 of 2022 (arising out of Rail P.S. Jahanabad(Taregna) Case No.66 of 2022 dated 18.06.2022 lodged under Sections 147/ 148/ 149/ 186/ 447/ 341/ 323/ 325/ 307/ 332/ 333/ 337/ 338/ 353/ 380/ 427/ 435/ 436/ 506/ 120B of the I.P.C. read with Section 3/4 damage to Public Property Act, and Sections 146/ 147/ 151/ 153/ 174 Railway Act and 27 of the Arms Act.

As per the prosecution case, the petitioners have participated in the Agni Veer and on the instance of the state, they were named accused in the two criminal cases save and

Patna High Court CR. MISC. No.8979 of 2023(2) dt.03-05-2023 2/2 except, there is no other case pending against them. Learned counsel for the petitioners submits that petitioners are noway involved in commission of crime. Counsel further submits that petitioners are in custody since 18.06.2022. Counsel submits that this Court has pleased to grant bail to the other accused persons involved in the Agni Veer Case vide order dated 23.12.2022 in Criminal Miscellaneous No. 56839 of 2022 with analogous cases.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge -XI, Patna in connection with Sessions Trial No. 1063 of 2022 (arising out of Rail P.S. Jahanabad(Taregna) Case No.66 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
