The petitioner seeks bail in a case registered for the offences punishable under sections 341, 323, 326, 504, 307 of the Indian Penal Code.
It is alleged that the petitioner armed with Barchha came near his house, abused and assaulted on the chest of father of the informant with the said Barchha as a result of which he sustained injuries. The occurrence is alleged to have taken place with respect to playing of children between both the parties. It has been submitted on behalf of the petitioner that he is in custody since 30.05.2015. Charge-sheet has been submitted in the case. Petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.39338 of 2015 (3) dt.09-10-2015 There is no allegation of tampering with the evidence against the petitioner. There is case and counter case. Both sides have sustained injuries. It has further been submitted that the petitioner may be released after completion of six months in custody from 30.05.2015.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail after completion of six months in custody from 30.05.2015 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Simultala P.S.
