Petitioner seeks bail in connection Pirpainti (Bakharpur) P.S. Case no. 06 of 2020 registered for the offence punishable under sections 392 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant has alleged that when the informant reached near grocery shop of Umesh Mandal, three persons stopped him, assaulted him and snatched Rs 8,000/- which was sale proceed and also looted one mobile and his motorcycle and thereafter miscreants fled away. Further, informant identified the present petitioner as well as Dharmendra Mandal and Vinod Mandal.

No.19673 of 2021(3) dt.16-11-2021 2/2 He further submits that petitioner is in custody since 06.11.2020 and he is person with clean antecedent and from the FIR itself, it would manifest that two criminals who were apprehended namely Dharmendra Mandal and Vinod Mandal disclosed the names of two other accused including petitioner as their associates but petitioner was not apprehended at the spot. Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is a person with clean antecedent and his name was disclosed by Dharmendra Mandal, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate XI, Bhagalpur in Pirpainti (Bakharpur) P.S. Case no. 06 of 2020.
