JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioners and the counsel appearing on behalf of the State as well as informant. Petitioners are father-in-law and mother-in-law are apprehending arrest in connection with Complaint Case No. C1581 of 2018 for the offence under section 498(A), 494, 406, 420, 504/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The marriage between the son of the petitioners and the informant took place on 7.6.2015. The informant is
Patna High Court CR. MISC. No.7029 of 2020(2) dt.28-02-2020 2/2 working as a teacher.
Learned counsel for the petitioners submits that family of the petitioners is ready to keep the opposite party no.2 with full honour and dignity.
Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Complaint Case No. C-1581 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C. After release of the petitioners, the Court below shall refer the matter to the mediation centre for amicable settlement of the disputes between the parties.
