The petitioner seeks bail in anticipation of his arrest in connection with Halis P.S. Case No. 200 of 2018 dated 24.11.2018 instituted for the offences under Sections 323, 307, 379, 504, 506 and 34 of the Indian Penal Code and under Section 27 of the Arms Act. After some arguments, Mr. Nawal Kishore Agrawal, learned senior counsel for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed on behalf of the petitioner, the court below shall take into account that there are series of litigation between the parties,

Patna High Court Cr.Misc. No.9424 of 2019(2) dt.19-02-2019 2/2 the grievous injuries suffered by the father of the informant does not appear to have been caused by a sharp cutting weapon viz. Bhala which has been attributed to the petitioner and that all the accused persons of the counter case viz. the informant and his associates have been granted bail by the court below and also that the petitioner is of clean antecedent and thereafter shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained.

The petition is dismissed as withdrawn with the liberty/observation aforesaid.
