2. The petitioners are apprehending their arrest in connection with Bahera P.S. Case No. 276 of 2025 registered for the offence under Sections 126(2), 115(2), 110, 352, 351(2) and 3(5) of the Indian Penal Code lodged on 01.08.20225 by the informant, Santosh Yadav.
3. As per the prosecution story, the informant alleged that while he was returning home after offering 'Puja' in the temple, the accused persons named resorted to assault. Allegation is that Lalan Yadav gave farsa blow on the head
2/4 while Ram Uttim Yadav gave 'tangi' blow again on the head. Chandu Yadav assaulted his mother while other accused persons also resorted to assault. This led to the F.I.R.
4. Learned counsel for the petitioners submit that only to implicate everyone, they have been named. The police during investigation found that Bindeshwar Yadav and his son, Binay Kumar Yadav have no role to play and have been implicated.

Learned APP opposes the prayer submitting that the allegation of assault at least is on Lalan Yadav and Ram Uttim Yadav though he concedes that there is no injury report so far as the assault theory that has been assigned to Chandu Yadav who is alleged to have inflicted repeated blows to the mother of the informant is concerned.
6. Considering the submissions of the parties, this Court is not inclined to extend the privilege of anticipatory bail to petitioner no.2, Ram Uttim Yadav as also the petitioner no.3, Lalan Yadav. Their anticipatory bail application stand rejected.
7. So far as the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav are convened, taking into account the fact that there is no injury report of the mother and no role has been assigned to Ram Adhin Yadav, in that background, this Court is inclined to
3/4 extend them the privilege of anticipatory bail.

Let the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga, in connection with Bahera P.S. Case No. 276 of 2025 subject to the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav who shall provide official document (Aadhar Card/Voter Id/Driving License/Pan Card) to show his/her bona fide;
(ii) the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav shall be appearing before the Police Station as and when required for cooperating in the investigation;
(iii) the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail
4/4 cancellation of his/her bail bond by the Trial Court itself; (iv) the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav shall appear before the concerned police station every month for next six months to mark his attendance and at the end of the period a certificate be submitted before the Trial Court failing which the State shall be at liberty to take steps for cancellation of bail bonds;
(v) the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(vi) the petitioner no.1, Chandu Kumar @ Chandu Yadav and petitioner no.4, Ram Adhin Yadav shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) Ravi/Shivangi U T
