JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-03-2015 The petitioner is in custody since 29.8.2014 in connection with Rupauli P.S.Case No. 11 of 2004 instituted under Sections 147, 148, 149, 342, 302, 201 and 120B of the Indian Penal Code. Learned counsel for the petitioner draws attention of this Court to the fact that as per the FIR itself there is no eye-witness. Even in course of investigation there is no eye-witness. It is only a grave suspicion.
Be that as it may, in the facts and circumstances, let the petitioner Shambhu Mandal be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Rupauli P.S.Case No. 11/04.
