The present petition has been filed with a prayer to restore Miscellaneous Appeal No. 866 of 2011 , which stood dismissed due to non compliance of peremptory order , which was passed long back on 3.7.2012. In the said Miscellaneous Appeal notice was directed to be issued to respondents for which requisites were to be filed within ten days. The said order was peremptory order. Though the Miscellaneous Appeal stood dismissed due to non compliance of peremptory order in the year 2012 itself the present restoration petition was filed in the month of September 2016.

Learned counsel for the petitioners by way of drawing my attention to certain statements made in the present petition

Patna High Court MJC No.3166 of 2016 (2) dt.28-09-2016 2/2 tried to persuade the Court to accept the reasons for delay, however the grounds which have been set forth in the petition is not sufficient to persuade the court.

The restoration petition stands dismissed.
