The petitioner apprehends his arrest in connection with Nagar P.S. Aurangabad Excise Case No.17 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Petitioner has criminal antecedent of similar nature and the witnesses present on the spot have stated that the
Patna High Court CR. MISC. No.10385 of 2022(2) dt.01-04-2022 2/2 recovered illicit liquor belonged to the petitioner. In view of the allegations levelled against the petitioner, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
