JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Sessions Trial No. 152 of 2021 arising out of Jhajha P.S. Case No. 335 of 2019 registered for the offences punishable under Sections 147, 148, 149, 447, 302 and 201 of the Indian Penal Code.
This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 12.04.2022 passed in Cr. Misc. 33589 of 2021 with liberty to renew his prayer for grant of regular bail after nine months. This Court vide order dated 22.02.2023 had called for a report from the trial court regarding stage of trial and in
Patna High Court CR. MISC. No.9600 of 2023(3) dt.22-03-2023 2/2 pursuance thereof, the report of learned 2nd Additional District & Sessions Judge, Jamui, dated 2.3.2023, is on record and from perusal of the same, it appears that out of seven charge sheet witnesses, three have already been examined and crossexamined. The trial court has given the estimated time to conclude the trial within four months.
In view of the aforesaid, I am not inclined to grant regular bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected. However, the petitioner may renew his prayer for bail after four months, if the trial does not show any progress. (Anil Kumar Sinha, J) S.Ali/- U T
