Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Nadi P.S. Case No.154 of 2020, (Spl Case no.-142 of 2020) registered for the offence under Sections 8(iii)/20 (b) (ii) (C)/22(C) of N.D.P.S. Act.

As per prosecution story, on 19.09.2020 the informant, who is a Sub-Inspector of Police, was on patrolling duty and when he was near Sabalpur six lane road he saw some persons fleeing away after throwing a plastic bag. These persons were chased and eventually they were caught and 05 Kg. of

Patna High Court CR. MISC. No.19733 of 2021(2) dt.15-11-2021 2/2 Ganja was recovered from the plastic bag which was thrown by them.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has falsely been implicated in this case. He further submits that petitioner has got no criminal antecedent. He also submits that similarly situated co-accused Ramekbal Kumar has been granted regular bail by a Co-ordinate Bench of this Court in Cr.Misc.No.20963 of 2021 dated 08.07.2021. Petitioner is in custody since 21.09.2020. However, learned APP for the State vehementally opposed the prayer for regular bail.

In the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XVI, Patna, District-Patna in connection with Nadi P.S. Case No. 154 of 2020 (Spl. Case No. 142 of 2020). (Rajesh Kumar Verma, J) Brajesh Kumar/- U T
