JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-02-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 11.03.2015 passed in Cr. Misc. No. 811 of 2015 on the ground that the petitioner is suffering in custody since 20.10.2014, the case is based on the circumstantial evidence and the confession of the petitioner has got no evidentiary value in the eye of law, the alleged recovery of Dupatta is of no value and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes. In the facts and circumstances as stated above, at this stage again prayer for bail of the petitioner stands rejected in connection with S.T. No. 200 of 2015 arising out of Bhargama

Patna High Court Cr.Misc. No.49527 of 2015 (3) dt.10-02-2016 2/2 P.S. Case No. 126 of 2014/ G.R. No. 2470 of 2014 pending in the court of 2nd Additional Sessions Judge, Araria. However, the trial court is directed to expedite the trial and to conclude the same preferably within six months, failing which the petitioner may be at liberty to renew his prayer for bail.
