JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 26-03-2019 The petitioner, who was an applicant/aspirant for being appointed as Anganbari Sevika is aggrieved by the fact that private respondent No. 11 has been appointed on the said post despite her being way down in the merit list.

2. It is the case of the petitioner that her name

Patna High Court CWJC No.4525 of 2019 dt.26-03-2019 2/3 figured at serial No. 3 in the merit list which was prepared whereas private respondent No. 11 was at serial No. 7 in the said merit list. Because of machinations of private respondent No. 10, an Anganbari Supervisor, respondent No. 11, who was already working as Anganbari Sahayika was wrongly adjusted on the post of Anganbari Sevika for which the petitioner was entitled. A complaint in that regard was made to all the authorities including the District Programme Officer, Kaimur at Bhabhua (respondent No. 4) which have yet not been looked at or responded to.

Under the aforesaid circumstances, this Court directs the petitioner to make a fresh complaint/representation before the District Programme Officer, Kaimur at Bhabhua (respondent No. 4) within a period of four weeks from today, detailing her grievances, who, on receipt of such complaint/representation shall dispose off the representation by a reasoned order, after affording opportunity of hearing to all respective parties within a further period of six weeks thereafter.

4. Should the petitioner feel aggrieved by the order

Patna High Court CWJC No.4525 of 2019 dt.26-03-2019 3/3 of the District Programme Officer, Kaimur at Bhabhua (respondent No. 4), she would have further opportunity of assailing such order of the District Programme Officer before the District Magistrate-cum-Collector, Kaimur at Bhabhua (respondent No. 3).

5. With the aforesaid observation/direction, the writ petition stands disposed off.
