2. The petitioner seeks bail in a case registered for offence under Sections 103 (1), 61 ( 2 ), 308 ( 2 ) and 352 of BNS and 25 (1-b)/a/27 of Arms Act.

3 . As per prosecution case , informant alleged that his son namely, Ram Kishore Chaudhary had gone out on 18.03.2025 and was shot while he was returning to home . It is further alleged that son of informant ( deceased ) was killed by all the named accused persons including this petitioner.

4. From perusal of the record, it appears that petitioner is not named in the F.I.R. The name of the petitioner transpired during course of investigation on his own

No.8850 of 2026(2) dt.16-02-2026 2/2 confessional statement recorded before police which is evident from paragraph-76 of the case diary, in which this petitioner has not only confessed his crime but also stated that after the commission of the crime he had concealed the loaded pistol in a small hole near the apartment of one Bittu Thakur and from paragraph-82 of the case diary, the alleged weapon was recovered from the same spot, as stated by this petitioner.

5. Considering the nature of accusation, materials available on record, gravity of offence and other circumstances of the case, the prayer of petitioner for regular bail is rejected. However, since petitioner is in custody since 23.04.2023 , learned Trial Court is directed to expedite and conclude the trial preferably within the period of one year from the date of receipt/production of copy of this order.
