For the Petitioner : Mr. Rajani Kant Singh, Advocate Mr. Surendra Kumar Mishra, Advocate For the Opposite Party : Mr. Prem Kumar Jha (APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 23-11-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Alakh Niranjan Kumar, in connection with Gaya Mahila Police Station Case No.13 of 2014, under Sections 498A/341/323/504/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act, pending in the Court of learned SubDivisional Judicial Magistrate, Sherghati, District-Gaya. Perused the above application and materials on record.

Heard Mr. Rajani Kant Singh, learned Counsel, appearing for the petitioner, and Mr. Prem Kumar Jha, learned Additional Public Prosecutor, appearing on behalf of the State. After some arguments, learned Counsel for the petitioner, seeks permission to withdraw this application with

Patna High Court Cr.Misc. No.48532 of 2015 (2) dt.23-11-2015 2/2 liberty to approach the appropriate authority with appropriate application, if so advised, and also to take recourse to such provisions of law as may be permissible.

No objection has been raised by the opposite party to the prayer for withdrawal made by the petitioner. In view of the above and in the interest of justice, this bail application is hereby disposed of as withdrawn with liberty granted to the petitioner to approach this Court or before the learned Sessions Judge with appropriate application, in future, if so advised, and also to take recourse to such provisions of law as may be permissible.
