The petitioner is in custody in connection with Ujiyarpur P.S. Case No.151 of 2019 for the offences under Sections 366 and 366A/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent. The petitioner is in custody since 30.9.2019. The petitioner is innocent and is in love affairs with the victim and that is why he has been made accused in this case.

The statement of the victim has been recorded under Section 164 Cr.P.C. which is against the petitioner. Considering the aforesaid, the Court is not inclined to

Patna High Court CR. MISC. No.10889 of 2020(3) dt.05-06-2020 2/2 grant bail to the petitioner. The prayer is rejected. However, the trial court is directed to expedite the trial and conclude the same at the earliest preferably within a period of nine months.
