2. This application has been filed for quashing of the cognizance order dated 31.07.2008 passed in Complaint Case No. 1606(C) of 2007 passed by the learned Judicial Magistrate 1st Class, Patna by summoning the petitioner to face the trial for the offences registered under Sections 420, 406, 120B of the Indian Penal Code and Section 138 of the NI Act.
3. It has jointly been submitted by the learned counsel for the parties that the dispute has been settled.
4. On 10.04.2025, learned counsel for the petitioner had handed over a cheque of Rs. 1,00,000/- (One Lakh) to the
Patna High Court CR. MISC. No.9851 of 2022(5) dt.29-04-2025 2/2 learned counsel for the O.P. No. 02 which has been encashed.
5. In these circumstances, both the parties jointly submitted that the proceedings be quashed against all the accused persons.
6. In view of the joint submission of the parties, this application is allowed.
7. Accordingly, the order taking cognizance dated 31.07.2008 passed in Complaint Case No. 1606(C) of 2007 passed by the learned Judicial Magistrate 1st Class, Patna is hereby quashed against all the accused persons. (Sandeep Kumar, J) Shishir/- U T
