1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Gogari P.S. Case No. 235 of 2020 registered under Sections 363, 366 and 120B of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner is not named in the first information report. Further he submits that the statements recorded under Section 164 Cr. P.C. (Annexure-2) the victim clearly stated that she voluntarily accompanied the petitioner and married with him in the temple. It is also submitted that petitioner has no criminal antecedent.

4. Having considered the facts and circumstances

Patna High Court CR. MISC. No.12673 of 2024(2) dt.18-03-2024 2/2 of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 235 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
