Counsel for the petitioner has filed the present application to set-aside the order dated 06.12.2012 passed by Deputy Collector Land Reform, Forbesganj in connection with B.L.D. Case No.95 of 2012-13 and order dated 13.03.2014 passed by Divisional Commissioner, Purnea in B.L.D. Appeal
Patna High Court CWJC No.21146 of 2014(2) dt.11-07-2023 2/2 No.127 of 2013.
Counsel for the petitioner submits that at the time of filing the writ petition the Bihar Land Tribunal was not functional but it is functional now.
Counsel for the State submits that the dispute is relating to the Schedule Act as mentioned under Section 9 of the Bihar Land Tribunal Act, 2009 (Bihar Act 9 of 2009). In this view of the matter, in the light of Section 15 of the Bihar Land Tribunal Act, 2009 (Bihar Act 9 of 2009) Registrar General, Patna High Court is directed to transfer this case forthwith before the Bihar Land Tribunal and Bihar Land Tribunal is directed to hear this matter within 90 days upon completion of the appearance of the parties including the petitioner.
With the aforesaid direction, this writ petition is hereby disposed off.
