Petitioners seek bail in connection with Danapur P.S. Case No. 14 of 2019 for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The prosecution case, as lodged by the police personnel, is that on information that some illicit liquor is concealed near school at Anand Bazar, the police conducted a raid. On seeing the police, petitioners tried to flee away, but were apprehended. From a bag near the water tank 15 litres of country-made liquor was recovered, and, accordingly, a seizure-

It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and have been falsely implicated in the aforesaid case. It is further submitted that nothing has been recovered from their conscious possession and are languishing in judicial custody since 05.01.2019.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Patna, in connection with Danapur P.S. Case No. 14/2019.
