The petitioner seeks bail in connection with Ekma P.S. Case No.162 of 2014/G.R. No.5457 of 2014 registered under Sections 302, 201 and 307/34 of the Indian Penal Code. The accusation is that the petitioner caused injury to the husband of the informant through spade and threw his dead body into the well with the help of his sons Rupak Giri and Dipak Giri. It is also alleged that all the accused persons including the petitioner assaulted the informant.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is no eye
Patna High Court Cr.Misc. No.48366 of 2015 (2) dt.09-11-2015 2/2 witness to the occurrence of causing assault to the husband of the informant, deceased Lalan Giri and throwing him into the well. In fact, Lalan Singh, the husband of the informant, was suffering from epilepsy and he was under treatment. Deceased might have gone near the well and fallen into the well at the event of suffering epilepsy. The informant, who is gotiya, has falsely implicated the petitioner and his other family members due to land dispute. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Divya Prakash, Judicial Magistrate, First Class, Chapra, in connection with Ekma P.S.
