JUSTICE SHIVAJI PANDEY ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and the State. Vide order dated 17th December 2014, this Court called for the status report of Nayagaon P.S.Case No.23 of 2013. As per the report dated 7th January 2015, the case has still not been committed to the court of Sessions.

Petitioner was caught on the spot. This Court is not inclined to grant bail to him. This petition is accordingly dismissed. However, direction is given to the court below that if other accused persons are not apprehended or they do not surrender, he will split the case of petitioner and expedite the trial. The process of commitment be completed within one month from the date of receipt of this order and the Court of sessions will frame charge and complete the trial within a period of one year

As all the witnesses are official witnesses, the prosecution is supposed to co-operate in the matter and the conducting Presiding Officer whenever he feels that he is not getting proper co-operation from the prosecuting agency, will have liberty to approach any Senior Police Official for securing presence of those witnesses.
