Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kishanganj P.S. Case No. 393 of 2022 dated 14.09.2022 lodged under Sections 420, 409 and 120(b)/34 of the I.P.C. The allegation of conspiracy made by the petitioner along with the criminals in the loot of cash van are there in the F.I.R.. It has been also alleged that the cash van has received Rs. 2.40 crore, loaded Rs. 37 lacs in two A.T.M. of S.B.I. and Rs.2.03 crore was there in the cash van which was alleged to grab under a deep rooted conspiracy, with this allegation this F.I.R. has been lodged.

Patna High Court CR. MISC. No.9509 of 2023(2) dt.03-05-2023 2/2 Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is one of the gun man of the cash van and his antecedent is clean. He further submits that petitioner is in custody since 17.09.2022 and charge sheet has been submitted in this case.

Learned counsel for the State opposes the prayer for bail and submits that there is an allegation of loot of huge amount of the government money under conspiracy. In the present facts and circumstances, I am not inclined to grant bail to the petitioner, therefore, bail petition of the petitioner is hereby rejected.

Trial court is directed to expedite the trial and conclude it within one year.

With this observation, the bail application stands rejected.
