Petitioner seeks bail in connection Bettiah Muffasil P.S. Case no. 703 of 2020 dated 06.11.2020 registered for the offence punishable under sections 413, 414/34 of the Indian Penal Code read with sections 25(I-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is in custody since 06.11.2020 and charge sheet has been submitted on 03.01.2021 and petitioner is person with clean antecedent. Further, nothing has been recovered from his possession.

Learned APP vehemently opposed the prayer for bail. Considering the facts that petitioner is in jail custody

Patna High Court CR. MISC. No.19608 of 2021(2) dt.15-11-2021 2/2 since 06.11.2020, charge sheet has been submitted and petitioner is a person with clean antecedent, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Bettiah Muffasil P.S. Case no. 703 of 2020.
