Prayer of the petitioner is for quashing of the order dated 4.1.2020 contained in Annexure-3 passed by three Men's Committee constituted for the purpose of redressal of grievances of the District Units of the Bihar Cricket Association. By the impugned order, the three Men's Committee has declared Ravi Kiran Group as duly constituted Executive committee of

Patna High Court CWJC No.5549 of 2020(2) dt.27-07-2021 2/2 the Muzaffarpur District Cricket Association.

Mr. Raju Giri, learned counsel for the respondent No. 1 submits that as per the newly framed Bihar Cricket Association Rules (hereinafter referred to as the "Rules"), the petitioner has got alternative remedy to file an application before the Ombudsman and at present Mr. Raghvendra Kumar Singh is working as Ombudsman in accordance with Rule 44 of the Rules.

4. In view of the aforesaid submission of learned counsel for the Respondent No. 1, learned counsel for the petitioner seeks permission to withdraw this writ application with liberty to file an application before Ombudsman.

5. Needless to say that if such an application is filed by the petitioner within a period of two weeks' from today, the Ombudsman shall dispose the same in accordance with law, preferably within a period of two months from the date of filing.

6. With aforesaid direction and observation, this writ application stands disposed of.
