The petitioner is in custody in relation to Khagaria Mufassil P.S.Case No. 679 of 2013, instituted under Sections 364A/34 of the Indian Penal Code, which is now pending trial as Sessions Trial No. 119 of 2014 pending before 3rd Ad-hoc Additional Sessions Judge, Khagaria.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and merely on the basis of suspicion raised by the Sarpanch and Mukhiya he has been implicated in this case, whereas learned counsel for the informant submits that in the course of investigation it revealed that ransom amount of Rs.90,000/- has been found and duly credited in the Bank Account of the mother-in-law and the petitioner. The kidnapped boy is yet to be recovered.
Patna High Court Cr.Misc. No.47076 of 2014 (2) dt.03-03-2015 Considering the aforesaid facts and circumstances, I am not inclined to entertain this application at this stage. It is, accordingly, dismissed.
