Mr.Madan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-02-2019 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners seek regular bail in connection with Gaurichak PS case no. 21 of 2018 registered for the offence punishable under Sections 30(a), 37(b) of Bihar Prohibition and Excise Act, 2016.

The allegation is regarding three accused persons having been apprehended by the police in an inebriated condition and when they were interrogated by the police, they disclosed that they had purchased mahua wine from the petitioners herein.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case, they are having clean antecedent and they are

Patna High Court Cr.Misc. No.9711 of 2019(2) dt.19-02-2019 2/2 languishing in custody since 09.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the abovenamed petitioners are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise) Patna in connection with Gaurichak PS case no. 21 of 2018.
