The petitioner, Abhishek Kumar is in custody in Mokama P.S Case No. 157 of 2015 under Section 394 I.P.C. since 23.08.2015.

The F.I.R of looting the informant is against unknown.

From perusal of the case diary, it appears that no T.I. parade has been held nor the looted articles have been recovered form the possession of the petitioner. There is no evidence that the motorcycle recovered from the house of the petitioner was used by the criminals.

Considering the above facts and circumstances of the case, I direct that the petitioner be released on bail on furnishing

Patna High Court Cr.Misc. No.50462 of 2015 (3) dt.30-01-2016 2/2 bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate Ist Class, Barh (District-Patna) in connection with Mokama P.S Case No. 157 of 2015.
