2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 316 (5) , 318 ( 4 ) , 61 ( 2 ) of BNS 2023 .

3 . The prosecution case in brief, is that all the accused persons named in the F.I.R., deposited customer's money in their personal account. It is further alleged that on the basis of 17 written complaints a primary inquiry was conducted and it was found that all the accused persons misappropriated Rs. 16,25,500/- and further alleged that Sangeeta Singh, Gopal Jha and Indrajit Kumar have misused their respective position as

4. It is submitted on behalf of the petitioners that petitioner is not named in the F.I.R., and his name transpire during course of investigation. It is further submitted that as per F.I.R., the R.D. account opened in the year 2018-2020 in the post office through MPKBY agent Sangeeta Singh and other employees of post office. The petitioner was appointed as a postal assistant on 11.02.2022 in the head post office in Sitamarhi, and as such, the petitioner cannot be held responsible for the aforementioned period. The specific allegation is against co-accused Gopal Jha, and at the relevant time, during the alleged period when the several accounts were opened, this petitioner was not posted in the barnch and as such, this petitioner has falsely been implicated in this case . 5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount
