JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Gaurichak P.S. Case No. 383 of 2019 registered for the offence punishable under Sections 302/120(B) of the Indian Penal code and Section 27 of the Arms Act.
Allegation against the petitioner and 7 other accused persons are of indiscriminate firing and causing injury of to the father of the informant who later on succumbed his death. Submission of learned counsel for the petitioner is that altogether 8 persons are named in the FIR including the petitioner and the petitioner is in custody since 18.10.2019 and moreover he is aged about 70 years which will appear from the impugned order also.
Heard learned A.P.P. as well as learned counsel for the informant who have opposed the prayer for bail stating that
Patna High Court CR. MISC. No.8044 of 2020(2) dt.20-02-2020 2/2 there are specific allegation of firing against the petitioner but it does not disclose in the FIR.
Having heard both sides, considering the age of the petitioner and allegation is general in nature, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Patna City, Patna in connection with Gaurichak P.S. Case No. 383 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
