The petitioner has been arrested in connection with Kudra P.S. Case No. 57 of 2015 registered under Sections 420 and 409 of Indian Penal Code.

Learned counsel for the petitioner submits that out of Rs.63,00,000/- and odd, the petitioner has already paid Rs. 24,00,000/- and rest amount of Rs. 39,00,000/- will be paid in four equal installments i.e. first three installments of Rs.10,00,000/- each and rest amount will be paid as fourth installment. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on provisional bail for six months on furnishing bail bond of Rs.50,000/- (fifty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Kudra P.S. Case No. 57 of 2015, subject to condition that after release, the petitioner will pay Rs.10,00,000/- as first installment within six weeks and thereafter,

No.51709 of 2015 (2) dt.10-11-2015 he will go to pay two installment of Rs. 10,00,000/- at the interval of six weeks each and the rest amount will be paid as fourth installment at interval of six weeks. However, in case of any breach of condition for grant of bail, the bail bond of the petitioner shall stand cancel and the court below shall cancel the bail bond and take coercive step against the petitioner and if the condition is fulfilled then the provisional bail shall confirmed. m.p.
