Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 498(A), 341, 323, 504 and 506/434 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act, registered in connection with Mahila P.S.Case No. 75 of 2020.

It is a case of matrimonial dispute. The matter was was earlier referred to the Patna High Court Mediation and

Patna High Court CR. MISC. No.19521 of 2021(5) dt.04-08-2022 2/3 Conciliation Centre. Both the parties have compromised the case. As per the terms and conditions of the compromise petition, the petitioner was to pay Rs. 3,00,000/- as maintenance to his wife Karishma Kumari. The first instalment of Rs. 1,50,000/- was to be paid on 2nd of August, 2022, whereas the second instalment of Rs. 1,50,000/ is to be paid till 31st of August, 2022. It was also agreed upon that the motor-cycle bearing Registration No. BR21U6298 shall be returned to Karishma Kumari.

The learned counsel for the petitioner has submitted that the petitioner has paid the first instalment of Rs. 1,50,000/- and also returned the motor-cycle and he will pay the second instalment of maintenance amount till 31st of August, 2022. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bihar Sharif, Nalanda in connection with Nalanda Mahila P.S.Case No. 75 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Patna High Court CR. MISC. No.19521 of 2021(5) dt.04-08-2022 3/3 Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
