The present writ application has been filed seeking a direction to the respondents to take action against the respondent no. 5 for humiliating and physically assaulting the petitioner for an incident alleged to have taken place on 08.09.2014.

Counter affidavit has been filed on behalf of the respondents no. 1 to 4 in which it has been stated that enquiry report has been submitted on the basis of which recommendation for initiating departmental proceeding has been sent to the D.I.G., Patna against the concerned

Patna High Court Cr. WJC No.1172 of 2014 (3) dt.29-07-2015 2/2 respondent no. 5 and pursuant thereto departmental proceeding has also been initiated on 23.07.2015. In view of the aforesaid, the application having become infructuous stands disposed off.
