1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Sessions Trial no.531 of 2024, arising out of Pandarak P.S Case no. 266 of 2023 registered under sections 302, 120B, 341 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the informant states that on the orders of Subodh Yadav while Parsuram Kumar @ Pasa and Janak Kumar caught hold of his son, Ayush Kumar is stated to have fired on him with his pistol as a result of which he sustained firearm injury and died.

Patna High Court CR. MISC. No.8290 of 2025(2) dt.15-02-2025 2/3 petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 12.7.2024 (Annexure-1) passed in Cr. Misc. no. 41436 of 2024 giving liberty to the petitioner to renew his prayer for bail after six months or on framing of charge, whichever is later. The petitioner has remained in custody for more than six months since the said order of rejection and referring to the order of the learned Court below rejecting the application for bail of the petitioner, it is submitted that charge has been framed and the case is pending for prosecution evidence. The petitioner is in custody since 14.11.2023 and undertakes to cooperate in the trial.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, liberty granted to the petitioner by the aforesaid order of rejection dated 12.7.2024, the petitioner having remained in custody since 14.11.2023 and charge having been framed in the learned trial Court, the petitioner is directed to be enlarged on bail in connection with Sessions Trial no.531 of 2024 (arising out of Pandarak P.S Case no. 266 of 2023) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief
