JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 The petitioner is accused in a case under section 302/401/34 of the IPC.

Prayer for bail of the petitioner was earlier refused by this court on 3.8.2011, 27.8.2012, 9.5.2013 and lastly on 16.5.2014 with a direction for expediting the trial. Learned counsel for the petitioner submits that the petitioner is in custody since 30.3.2011 and there is no eye witness to the occurrence.

The prayer for bail of the petitioner is refused with direction to the trial court i.e. the court of Addl. Sessions Judge V, Vaishali at Hajipur to expedite the trial of Sessions Trial No. 321 of 2011 within a period of three months from the date of receipt/production of a copy of this order, failing which the trial court would itself release the petitioner on bail to its satisfaction including the conditions imposed, if any.
