====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-01-2022 Heard Mr. Arjun Pd. Keshri, learned Advocate for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners seek bail in anticipation of their arrest in connection with Sono (Charka Patthar) P. S. Case No. 82 of 2020 instituted for the offences under Sections 147, 148, 149, 341, 323, 308, 379, 504 and 506 of the Indian Penal Code. The accusation against the petitioners and others is of assaulting the members of the prosecution party, leaving several persons injured.
The learned counsel for the petitioners has submitted that there is a counter version of the occurrence lodged by
Patna High Court CR. MISC. No.19419 of 2021(2) dt.12-01-2022 2/3 petitioner no.2. In the aforesaid occurrence, petitioner no.1 has received grievous injuries. All the persons injured in the subject F.I.R. have received simple injuries except the informant who has received grievous injuries.
The learned counsel for the petitioners has further submitted that the accusation against them are general and omnibus and not specific. He reiterates that in the counter version with respect to the same transaction, the petitioner no.1 has also received grievous injuries. Apart from this, it has been submitted that the accused persons of the counter case have been granted bail. Some of them have been granted anticipatory bail also by different Benches of this Court. The parties are at loggerheads with respect to a civil dispute.
Considering the afore-noted submissions on behalf of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with
Patna High Court CR. MISC. No.19419 of 2021(2) dt.12-01-2022 3/3 Sono (Charka Patthar) P. S. Case No. 82 of 2020, subject to the condition as laid down under Section 438 (2) Cr. P.C. The application stands allowed.
