====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 27-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Madanpur P.S. Case No. 149 of 2021 dated 25.06.2021 registered for the offences punishable under Sections 30(a) and 33 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution case, total 280 litres of spirit liquor was recovered, out of which, 140 litres of spirit liquor was recovered from the house of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that no incriminating article has been recovered from his possession. He was not present at the spot.

Patna High Court CR. MISC. No.9466 of 2025(2) dt.27-03-2025 2/2 He has no concern with the alleged offence. The said illegal spirit liquor was recovered from the joint house of the petitioner. There is no statutory compliance of Section 100 of the Cr.P.C. The petitioner is a sole earner of his family. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 04.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-cum-Exclusive Special Judge, Excise Court-01, Aurangabad in connection with Madanpur P.S. Case No. 149 of 2021.

7. The application stands allowed.
