The petitioner seeks regular bail in connection with Hajipur Sadar PS case no. 693 of 2018 registered for the offence punishable under Sections 356, 379, 414 of Indian Penal Code.

The allegation is regarding the petitioner and one co-accused person having followed the motorcycle of the informant and his wife and after intercepting them, they are said to have snatched the bag containing Rs. 3,000/-, however the petitioner was apprehended but the other accused persons managed to flee away and from the possession of the petitioner, one motorcycle, which seemed to be stolen one, and one Samsung mobile was recovered.

Patna High Court Cr.Misc. No.9707 of 2019(2) dt.20-02-2019 2/2 The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having clean antecedent, however since the allegation is regarding the petitioner having been caught on the spot, the learned counsel for the petitioner submits that the petitioner is ready to furnish cash security for the purposes of grant of regular bail. The petitioner is stated to be languishing in custody since 22.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail upon deposit of a sum of Rs. 10,000/- by way of cash security subject to such other conditions as may be imposed by the learned Court C.J.M. Vaishali at Hajipur in connection with Hajipur Sadar PS case no. 693 of 2018. With the aforesaid direction, the present bail petition stands disposed of.
