Petitioner has filed the present writ application challenging the order of suspension dated 04.05.2018. The suspension order was passed one year back was in contemplation of departmental proceeding.
Under the aforesaid circumstances, the Court does not find any justification to allow the suspension to continue any further after expiry of one year.
Accordingly, the writ application is allowed. The order of suspension contained in Annexure-2 is hereby quashed. The respondents are granted liberty to conclude the
Patna High Court CWJC No.9810 of 2018(2) dt.02-07-2019 2/2 departmental proceeding within a period of four months from the date of receipt/production of copy of this order, failing which the departmental proceeding shall also come to an end and the petitioner shall be entitled to all consequential benefits on reinstatement.
With the aforesaid, the present writ application stands disposed of.
