The petitioner is languishing in custody since 30.11.2018 in a case registered for the offence punishable under Sections 354, 354-D, 34, 500 of the Indian Penal Code. It is alleged that a photograph of the daughter of the informant, namely, Khushbu Kumari aged about 15 years made viral on the social media along with photo of two boys namely Padu Turi and Pravesh Turi @ Buta Turi. The informant came to know this fact through his nephew that the petitioner was also instrumental in making the photograph of her daughter viral on the social media.

It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the accusation has been

It is further submitted that no substantial material showing the involvement of the petitioner in the alleged occurrence has been collected during investigation. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP for the State submits that the petitioner's name sprang up as one of the conspirator. Considering the thrust of accusation against two co-accused persons whose photographs went viral on the social media along the with daughter of the informant, coupled with statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Barachatti P.S. Case No. 749 of 2018.
