JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 8.10.2014 in a case registered for the offences punishable under Sections 341,324 and 376 of the Indian Penal Code.

The accusation is of ravishing the informant and causing injury with knife.

It is submitted by the learned counsel for the petitioner that the informant lodged Barhat P.S. Case No. 66 of 2012 alleging attempt to rape against Ramesh Das in which the petitioner deposed during investigation against the informant. Hence, the petitioner has been roped in the present case. In the present case final form has been submitted vide Charge Sheet No. 39/2014 under sections 341,323,324 and 307 IPC. It is further submitted that the accusation under section 376 IPC has not been

It is submitted by the learned counsel for the informant that the informant has filed protest petition but the learned court below has not passed any order on the question of cognizance. Considering the fact that the petitioner was a witness against the informant in the earlier case of similar nature filed against Ramesh Das and that the accusation has not been found true under section 376 IPC during investigation, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jamui in connection with Barhat P.S. Case No. 9 of 2014.
